In addition, both parties do not have to be present for mediation because mediators can hold separate sessions.
What are private trials?
If you do need to resort to litigation, Texas offers the option of private trials. A public trial is open for anyone to attend, as the name suggests. By comparison, both parties can agree to a private trial and select a private judge who will hear their issues and render decisions. This process will keep their matters confidential.
Can you have your court records sealed?
It is possible to have court records sealed to protect sensitive information. There must be a substantial reason to seal a record. Acceptable reasons might include:
Domestic violence
Child abuse
Financial fraud
Generally the court will agree to seal records when public disclosure would harm either one or both of the parties.
After the court determines your case is eligible to be sealed, your attorney must file a motion to seal, explaining why certain information would be harmful and why sealing is necessary. Depending on the jurisdiction, the attorney might have to serve notice of the motion to the other party.
