1. At what point should I see a divorce lawyer?
If there is any chance you can reconcile with your spouse and save the marriage, you should get marriage counseling before seeing a lawyer. However, if divorce appears inevitable, it is wise to begin divorce planning (link) as early as possible. This is particularly true if you are dealing with considerable assets. Asset protection will be an important aspect of your divorce.
2. If I want a divorce but my spouse doesn't, can I still get a divorce?
Yes, you can. Texas used to require proving fault on the part of the other spouse to file for divorce. However, today no-fault grounds are the most common grounds for divorce. Essentially a no-fault divorce means that you and your spouse cannot repair your marriage, and the legal term for this is “irreconcilable differences,” also called “insupportability.” In other words, one or both couples can no longer support continuing the marriage. Texas courts do not make a spouse stay in a marriage that they do not want.
3. What is attorney-client privilege?
Attorney-client privilege is a legal term that means the attorney will not disclose any information you have spoken or written to the lawyer. It becomes confidential and privileged information. For example, if you had an affair with another person during your marriage and told your lawyer about it, your lawyer cannot tell anyone about it. Any written information you share with your attorney, such as documentation about finances or communication through emails or phone conversations fall under the attorney-client privilege. Your communications remain confidential.
4. What is an uncontested divorce?
In an uncontested divorce, both spouses agree on the grounds and terms of the divorce. Typically, terms involve property division, spousal support (if applicable), and if they coupled has minor children, also child custody, visitation and child support. Some divorces may have contested terms when the divorce begins, but through negotiations or mediations, the terms become uncontested.
