What Are the Circumstances under Which a Texas Divorce Case May Be Reopened?

In Texas, there are generally two ways that a finalized divorce may be reopened:

  • If one of the parties can show that a legal error was made, a motion for a new trial may be filed, but this must be done within 30 days of the date of the final divorce decree
  • If more than 30 days have elapsed since the court issued the divorce order, one of the parties may ask to have the proceedings reopened, but only under extremely limited circumstances:
    • Where the party can show a material change in circumstances, particularly if it affects the emotional or physical health or well-being of a minor child
    • Where there is evidence that one of the parties to the divorce provided intentionally false information during the proceedings or otherwise engaged in and benefited from some type of fraud during the original proceedings. Studies show that financial fraud is widespread within marriages in the United States.
