If you’re considering filing for divorce or have already made the decision to end your marriage, you have lots of questions. Here are some of the most important ones you’ll want to ask your attorney during the first consultation:
- HoHow much will it cost for the divorce? The total fees will vary, based on the circumstances. Make certain you understand how the attorney bills (hourly, flat fee). Will the lawyer require a retainer? How often will you be billed? What additional costs are not included in the attorney fees?
- What steps does the attorney anticipate will be involved in the process? Does the attorney recommend or believe that you can settle without going to trial? Are there alternate means of dispute resolution, such as collaborative divorce or mediation, that are either mandatory or optional?
- How much experience does the lawyer have? What types of cases has he or she handled in the past? Can the attorney provide contact information for a former client who will talk about their experience?
- How often will the attorney call or communicate with you? What is his or her preferred method of communication?
- How long will it take for the divorce to be final? A survey published on Lawyers.com found that, when a divorce was essentially uncontested, it took an average of 8 months from filing to final order. Of course, your attorney won’t be able to give you a specific answer, but should be able to estimate, based on his or her knowledge of your case and of the courts.
- How should you communicate with your ex moving forward? Should all communications go through counsel?
- What documents does the attorney need you to gather?
