The Information You Must Provide When You Seek to Dissolve a Marriage

Though some televised courtroom dramas might suggest otherwise, there are required disclosures when you file any type of legal action in Texas, including a petition for divorce. The process works most effectively when all parties have access to all relevant information. What must you disclose to your spouse when you are involved in a divorce?

The Disclosures Compelled by Texas Law in a Divorce Proceeding

To initiate a divorce in Texas, one party must file a civil complaint in the district court in a county where one of the parties has lived for at least three months. You cannot file for divorce in Texas until you have lived in the state for at least six months.

The initial complaint necessarily includes certain disclosures:

  • The names of the parties involved in the divorce, as well as their contact information
  • Identification of any minor children of the marriage
  • The cause for the divorce—Texas is a “no-fault” state for purposes of divorce, but a person seeking to dissolve a marriage must nonetheless cite “insupportability” as the basis for the divorce. As a part of the divorce complaint, the party seeking the divorce must set forth his or her “legal theories,” essentially advising the court and the other party as to why a divorce is warranted.
  • Basic financial information, including documents setting forth all real property interests, statements for all financial accounts, retirement plans, investments and insurance policies. At some point, the parties will typically be required to provide copies of recent income tax returns, as well as payroll or other compensation materials.
