If you have children in the marital home, but want your divorce proceeding to be uncontested, you must find a way to agree on all matters, including those related to the children. That means you must find common ground with respect to legal and physical custody, with respect to where the children will spend their time and with respect to when the non-custodial parent will have parental time. In addition, you must agree on the amount of child support and who is responsible.
What Will an Uncontested Divorce Proceeding Look Like?
Because matters are uncontested, there will typically be no court hearings. Your attorney will file all documents with the court and will work out the terms of the final divorce decree. These proceedings typically allow for a divorce to final with significantly less expense and time.
