Will a Pregnancy Have Any Impact on Your Ability to Terminate Your Marriage?
Your marriage isn’t working and you’ve decided that the best way forward is through divorce. Then you discover that you’re expecting a child. Can you still get a divorce in Texas if you learn you are pregnant? What is the potential impact of discovering that you are pregnant on a divorce proceeding?
Divorce in Texas When You Find Out You Are Pregnant
Studies show that about one of every two divorces in the United States are filed during the first 7 years of marriage. The data also shows that the majority of first children are born during this time. Not surprisingly, then, it’s not unusual for a mother to discover she’s pregnant after a divorce petition has been filed.
Under Texas law, a divorce cannot be finalized when one party is pregnant. If it’s determined that the child is the biological offspring of the husband in the divorce proceeding, the court may not issue a divorce decree until the child is born, as the decree must include provisions for custody, visitation and support. If, on the other hand, the parties do not believe that the husband is the biological father, the divorce cannot be finalized until the paternity of the child is determined.
